1. Use without Registration
Our experience shows that most entrepreneurs usually think that registration of intellectual property is costly and unnecessary. As the Trademark Office’s system is on a first come first served basis, other parties can claim the exclusivity to the mark in advance of you. If this happens to your case, you have to proceed with cancellation of the registration and this process costs more than the filing fee. In this regard, having a registration is better than having no registration in order to avoid a future legal dispute.
2. File without Search
If the budget is not your concern, to conduct a trademark search before filing is therefore recommended. This is to ensure that there is no identical / similar mark filed in advance of you.
3. To Avoid Website Translator
A Website translator may not reflect all goods / service and hence the reduction of scope of protection. A Trademark Attorney can assist you here. The Trademarks Act provides protection for goods/services which have been registered only.
